Legal action on removal of panels

Complaint against A Shade Greener

Has anyone took ASG to court over having the panels temporarily removed? The lease agreement clearly states ASG will temporarily remove the panels at ‘NO CHARGE’ but charges have been incurred. 1 Use of my scaffold which is at a charge to myself 2 Supply 12 spare roof tiles again at a charge to myself 3 £1000 ‘bond’ (whatever you wish to all it) losses of interest All of which is not in the lease agreement, and I’ve found out these policies have been introduced after the agreement was signed. I just thought I’d ask on here before I see my solicitor.

Jon, I am having exactly the same issue now. Can you please let me know what the outcome of this was for you. ASG are trying to charge me £1000 “bond “, 12 roof tiles and scaffolding, to remove the panels which I am refusing to pay for because as you say it clearly says in the contract FREE OF CHARGE. I am coming up against brick wall in ASG and the ombudsman don’t cover this type of business.

Jim, I’d recommend sending them a letter stating if they want to use your scaffold then a cost will in incurred or they will have to use there own to remove the panels then they will have to remove it so your roofer can put there’s up then ASG will have to put it up again to put panels back on. Secondly instruct them that you will charge them for the roof tiles.

Thirdly get then to say why they want £1000 bond to remove there panels and why it’s not in your contract, fourthly threaten to turn the panels off until they remove them at ‘no cost to yourself’

Jon, Thank you for the reply. I have written to their complaints department asking for the reason behind the charge. I also said if it is acceptable for the tennant to introduce bonds out of contract then it must also be ok for the landlord (me). I’ll write another letter with your other points and await the outcome. Did you get the results you desired from this? Thank you for the info. Jim

It’s because some people have problems with birds nesting under the panels. ASG won’t fit nets to stop this so people have asked for panels to be removed for work to be done on roof and not letting ASG back to refit

Jim, I got the cost of the tiles, I have a great roofer and he gave me a receipt for the tiles which they insisted on, think they were shocked with the price my roofer charged £££ lol. I wish I had time before I needed the work doing to get documentation from them first for the costs. I have since found out why they are charging £1000.

Paid £1000 on a credit card and it showed on statement in and out on same day, they did remove panels and refitted them at no cost, think they want bond to make sure they can refit them. I got cost of roof tiles back after fighting for it, but couldn’t get money of them for using my scaffolding, after roof was replaced the panels were back on within the week.

Hi. Has anyone got any further information regarding removal and storage of solar panels whilst getting roof renewed. Can they just insist on using your equipment (scaffolding) free of charge? I don't mind paying the 'bond' as such, as I am happy to get them refitted after the work, but 'giving' them tiles and use of scaffold is not in the contract. Any info would be appreciated.

Oh dear Lord I am so surprised to read just how many people are plagued by pigeons under their solar panels. Ours were installed in 2012. The last 2 years pigeons have occupied the space between the panels and the ridge, creating an unhealthy balance of detritus and grasses growing everywhere including in the guttering. A shade greener have ruined my house. I don't have the money to pay out.

Darren gilliver why are they not refitting after your convirsion? I've just contacted them to have them taken down to have the roof fixed after storm damage and the said they can take them down in august! Unless I pay £1000 to have them done sooner.

David Lacy. That post was from N Khan. My problem with them is their refusal to remove the panels so I can repair my roof unless I agree to conditions which are not in the lease agreement.

N Khan why won’t they refit them? Im having problems getting them to remove the panels for an extension and loft conversion. Did you have a dorma roof or velux windows?

Don’t know if everyone can see this or not, but it might be the time they got a taste of their own medicine. Maybe turn panels off and don’t let them into your home until they pay a bond of £1000 or maybe just report them to Watchdog

Hi, Jon, are you having leaks in your roof beneath the panels and Is that the reason you need them removed? ASG cannot change conditions to the lease without first having a Deed of Variation being put on the lease. To do this the landlord/ you and Tenant/ASG must BOTH be in agreement. Get a SE or roofers written report if they suspect damage was caused by installation of the panels.
