Complaint against Shpock

I purchased an iphone5 on shpock yesterday. The seller told me the phone is on EE network. He arrange to get the phone unlock to O2 for me. I wanted the phone for my son birthday present he knew this. We met up and I paid for the phone. He told me that he would keep the shpock site open because he still has the box for the phone at home. I soon found out that the phone is not unlock and he has delete the item from shpock so I cannot report him. I need more information from him to get the phone unlock. I am going to be out of pocket. This is unfair what can I do next
