Complaint against Tui

I am writing regarding flight TOM449 on 25 June 2016 from Antalya to Birmingham Airport with the scheduled departure time of 2105hrs. This flight arrived seven and a half hours late at Birmingham Airport. The judgment of the Court of Justice of the European Union in Tui & others v CAA confirmed the applicability of compensation for delay as set out in the Sturgeon case. As such, I am seeking compensation under EC Regulation 261/2004 for this delayed flight. My scheduled flight length was 3060 kilometres, therefore I am seeking €400 per delayed passenger in my party. The total is €800 for all passengers. Prior to departure from Antalya, the pilot explained that he and the crew had been called in to work on a day off due to difficulties providing an outbound flight from Birmingham. He further explained that the delay had been made worse after passengers on the outbound flight had to be bussed to Manchester. It seems incredible that an airline like Thomson’s could not be better prepared for such a lengthy delay which appears to be the result of poor planning on behalf of the airline. The unacceptable delay, and lack of Thomson representation at Antalya airport led to a disappointing conclusion to our holiday. We were told we would receive food vouchers while at the airport, these were not forthcoming. However, we were able to show our boarding cards for a slice of unappetising pizza and a fizzy drink. We were then charged for tea and coffee on the return flight, and promised a letter on exiting the plane for details of why the flight had been delayed. This was not forthcoming. On arrival at Birmingham Airport, there was a further delay after the steps to the aircraft were wheeled into position, but passengers were not allowed to disembark. Again, no explanation was offered for this. I can provide boarding cards and photographic evidence of the fight departure screen, should you require it.

Thomson finally coughed up the full compensation amount. I'd like to thank A Spokesman Said for keeping the pressure on Thomson and also keeping me up to date, unlike Thomson.
