LowCostHolidays has gone bust – what you can do if you’re a victim

It’s a nightmare scenario – you’ve paid for your holidays and they’re just around the corner.

Or, worst still, you’re already out there soaking up the sun.

And the company not only goes bust, you also discover the company has not ATOL protection.

So, what are your rights?

LowCostHolidays is reported to have been taking bookings hours before it went out of business, so many people are likely to be left desperate for information.

Around 27,000 people are already overseas on holiday having booked through LowCostHolidays and a further 110,000 are said to have booked and paid but not travelled.

According to the administrator, Smith and Williamson, many flights will still be valid whether you’ve yet to travel or are in resort.

This is because flights are usually paid for at the time of booking.

The bigger problem is with hotel bookings, or indeed any extras booked with Lowcosttravelgroup Ltd, Lowcostholidays Spain, Hoteling.com or Lowcostbeds.com A.G.

Customers In Resort

Customers who have booked a Holiday combination (Flight plus Hotel)

If you are already on holiday you will be in possession of your flight tickets which remain valid.

You may be asked by the hotel suppliers, transfer suppliers and car parking suppliers (if you have booked these services) to pay them locally which you may have to pay and reclaim against:

1. Your Travel Insurance provider (if you have travel insurance)

2 .Govern de les illes Balears (www.caib.es) who is the regulator of the Spanish Travel Agency

3.Your credit card provider for services not received.

Keep all receipts of expenses in order to claim a refund or compensation.

You should also register your claim at [email protected]

Customers Due to Travel

Customers who have booked a Holiday combination (Flight + Hotel)

If you have booked a combination - flights and accommodation (plus other services, e.g. transfer, car-hire, etc) - your contract for the flights will be direct with the airline and payment will have been made to them, in most cases at time of booking.

If you have your flight ticket from the airline, you will be able to check-in and travel as normal.

If you have not received your flight confirmation details, you should contact the airline to determine the status of your flight reservation. If the airline tells you your reservation is not confirmed, then you will need to rebook your flights with another provider and make a claim using the options outlined below.

Your hotel reservation will not be valid so you will have to re-book your hotel.

This also applies to any other services that you may have reserved through Lowcostholidays.com (e.g. transfer, car-hire, airport parking etc) with another company.

You can reclaim lost amounts against:

1. Your Travel Insurance provider (if you have travel Insurance)

2. Govern de les illes Balears (www.caib.es) who is the regulator of the Spanish Travel Agency.

3.Your credit card provider for services not received.

Keep all receipts in order to claim a refund or compensation.

You should also register your claim at [email protected]
